GENERAL CONDITIONS OF SALE

The 'online' contract, accepted on the website https://www.apicolturalapieve.it – Apicoltura di Marco Schiavone, with registered office in Serravalle Sesia (VC) 13037 Region Naula N° 27 and a consumer, through a system of telematic sale called e-commerce. By consumer we mean, in relation to contracts for the sale of goods or the provision of services, the natural person who acts for purposes unrelated to any business or professional activity carried out. With the term e-commerce we refer to all those activities and exchanges of information that revolve around economic transactions between individuals and organizations, including public administrations. This contract must therefore be concluded exclusively via the electronic channel called 'Internet', at the address www.apicolturalapieve.it Below are the conditions of sale established by the supplier, which will remain effective until they are modified by the same. Any changes, corrections or updates will be reported in the appropriate section dedicated to the conditions of sale that you find on the website www.apicolturalapieve.it and will be effective from the moment of their publication.

PURCHASER'S DUTIES

By confirming the order electronically, the Customer declares that he has read and fully accepts the conditions of sale and payment indicated in the purchase process and in this contract and the section relating to privacy and security; he also undertakes to read, print and keep the conditions of sale set out below as required by articles 3 and 4 of Legislative Decree n. 185/1999. It is expressly forbidden to enter false and/or invented personal data within the data collection forms necessary to complete the order, it is also expressly forbidden to enter third-party data or make multiple registrations for a single consumer. Apicoltura La Pieve di Marco Schiavone reserves the right to prosecute such actions and any other fraudulent action against it and/or to the detriment of other consumers.

SALES PRICES AND PURCHASE CONDITIONS

All sales prices of the items displayed in the e-commerce are inclusive of VAT. These prices may vary at any time without Apicoltura La Pieve di Marco Schiavone being required to give any notice; in any case, once the order for the product has been placed, the same will not undergo any price change. The shipment of all the items present and purchasable in the virtual shop www.apicolturalapieve.it covers the entire national territory.

DELIVERY

Delivery is made throughout Italy by courier BRT and is intended up to the closest point, reachable by the courier, to the address indicated by the customer in the order. The transport includes the relative unloading but not the portarage, the transport to the floor and the collection of the packaging. Delivery times vary from 24 to 72 hours from shipment of the goods, which will take place within three working days from receipt of the order. These terms are merely indicative and not binding. Apicoltura La Pieve di Marco Schiavone is in no way responsible for direct or indirect losses resulting from the fact that the carrier has delivered the products after the delivery date indicated in the general conditions. Upon delivery, the customer must check the integrity of the packaging. In case of discrepancy, the customer must refuse the goods and contest this discrepancy directly to the carrier and promptly send a written communication to Apicoltura La Pieve di Marco Schiavone with relative photos of the product. The signing of the delivery documents implies the unreserved acceptance of the goods by the customer. In the event of impossibility to execute an order due to unavailability of the material or other factors internal or external to the company, Apicoltura La Pieve di Marco Schiavone undertakes to promptly inform the customer, returning the amount already paid to the latter.

CHARACTERISTICS OF THE ITEMS

Apicoltura La Pieve di Marco Schiavone reserves the right to modify without notice, in order to improve the quality of the offers according to the continuous technological evolution, the articles and the characteristics of the goods present on the site. The customer is responsible for the choice of the items ordered and for the correspondence and conformity to their needs of the specifications indicated by Apicoltura La Pieve di Marco Schiavone Apicoltura La Pieve di Marco Schiavone does not give any guarantee as to the suitability of the articles for the specific use desired by the customer. Claims against any defective or missing parts must be sent to the headquarters of Apicoltura La Pieve di Marco Schiavone within 8 days of receipt of the items. Apicoltura La Pieve di Marco Schiavone is exempt from any responsibility for the use that is made of the products sold. Apicoltura La Pieve di Marco Schiavone is exempt from any responsibility for any direct and/or indirect damage caused by such use.

RIGHT OF WITHDRAWAL

The right of withdrawal is exercised with a written communication, to be sent to Apicoltura La Pieve di Marco Schiavone, at the headquarters by registered letter with return receipt. The notice of withdrawal must indicate the order number with reference to which the right of withdrawal is exercised, the goods that the consumer intends to return and the indication of the method chosen for the return in his favor of the amount paid in the price account. Apicoltura La Pieve di Marco Schiavone will refund the amount paid by the consumer in terms of the law, according to the various methods agreed with the latter. In case of withdrawal, the customer will be required to pay the full cost for the delivery; the difference due to the customer will be retained by Apicoltura La Pieve di Marco Schiavone at the time of repayment of the price previously paid. The consumer who makes use of the right of withdrawal will be required to return the item perfectly intact and unused, in all its parts.

CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE

Apicoltura La Pieve di Marco Schiavone has the right to terminate the stipulated contract by simply communicating it to the customer; in this case the customer will only be entitled to a refund of the sum already paid, expressly waiving from now on any further request by way of possible compensation. The obligations assumed by the customer pursuant to art. 1 (Obligations of the buyer), as well as the guarantee of the successful completion of the payment that the customer makes with the methods referred to in art. 3 (Payment systems) are essential, so that by express agreement, the customer's failure to fulfill only one of these obligations will result in the legal termination of the contract pursuant to art. 1456 of the civil code, without the need for a judicial decision, without prejudice to the right for Apicoltura La Pieve di Marco Schiavone to take legal action for compensation for further damage

JURISDICTION

For any dispute, the exclusively competent Court is Turin.

PROVISION AND TREATMENT OF PERSONAL DATA

Personal data is collected for the purpose of registering the customer and activating the procedures for the execution of this order and the related necessary communications; these data are processed electronically in compliance with the laws in force and may only be shown at the request of the judicial authority or other authorities authorized for this purpose by law. Personal data will be disclosed to subjects delegated to carry out the activities necessary for the execution of the stipulated contract and disclosed exclusively for this purpose, as expressly specified in the Legislative Decree 196/2003. Information and complaints – The management of e-commerce, including shipments, orders and payments, is managed by Apicoltura La Pieve di Marco Schiavone.
